1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding legal agreement between you and FlowMonkey ("FlowMonkey," "we," "us," or "our") governing your access to and use of the FlowMonkey website, applications, data, tools, signals, and all related services (collectively, the "Service"). By checking the acceptance box, clicking "I Agree," creating an account, paying for access, or using the Service in any way, you represent that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Service.

You represent that you are at least 18 years old, of legal age to form a binding contract, and not barred from using the Service under the laws of your jurisdiction.

2. Not Financial, Investment, Legal, or Tax Advice

FlowMonkey is a software and data-analytics tool. It is provided for informational and educational purposes only. Nothing on or produced by the Service — including maps, levels, apex readings, scores, setups, signals, watchlists, alerts, engine output, commentary, or any other content — is, or should be construed as, investment advice, financial advice, legal advice, tax advice, a recommendation, an offer, or a solicitation to buy, sell, or hold any security, option, derivative, or other financial instrument.

FlowMonkey is not a registered investment adviser, broker-dealer, commodity trading advisor, or financial planner, and does not act in a fiduciary capacity toward you. No content constitutes a suggestion that any transaction or strategy is suitable for you. You are solely responsible for evaluating the merits and risks of any decision.

You should consult your own licensed financial, legal, and tax professionals before making any trading or investment decision. You agree that you are not relying on FlowMonkey for advice of any kind.

3. Assumption of Risk

Trading and investing in securities, options, and derivatives involves substantial risk of loss and is not suitable for every investor. Options trading in particular can result in the total loss of your investment in a short period, and may expose you to losses exceeding your initial investment. You may lose some or all of your capital.

You acknowledge and agree that all trading decisions you make are your own, made at your own discretion and your own risk. You assume full and sole responsibility for any and all losses, damages, tax consequences, and liabilities arising from your use of the Service or any decision you make in connection with it.

4. No Guarantees; Past and Hypothetical Performance

FlowMonkey makes no representation, warranty, or guarantee of any kind regarding the accuracy, completeness, timeliness, reliability, or profitability of any content, data, signal, score, or result. Markets are unpredictable and any measurement or statistic may not recur.

Any performance figures, hit rates, historical measurements, backtests, grades, or "receipts" shown are historical or hypothetical, are provided for informational purposes only, and are NOT indicative of future results. Hypothetical and historical performance has inherent limitations and does not represent actual trading. No representation is made that any account will or is likely to achieve results similar to those shown.

Data may be delayed, incomplete, interrupted, or inaccurate due to upstream providers, exchanges, connectivity, or other factors outside our control.

5. Your Responsibilities and Conduct

You are responsible for your account credentials and all activity under your account. You agree not to: share, resell, redistribute, scrape, or republish the Service or its data; reverse engineer or attempt to derive underlying methods; use the Service for any unlawful purpose, including market manipulation or trading on the basis of material non-public information; or use automated means to access the Service except as we expressly permit.

Your access is personal, non-transferable, and licensed — not sold — to you for your individual use.

6. Subscriptions, Billing, and Refunds

Paid access is billed through our third-party payment processor on the plan you select (for example weekly or monthly). By subscribing you authorize recurring charges until you cancel. You may cancel at any time; cancellation stops future charges and ends access at the end of the current paid period.

Except where required by law, all payments are non-refundable, including for partial periods and for any period during which you did not use the Service. Founder and lifetime rates, where offered, apply only while the associated subscription remains continuously active and are subject to these Terms.

We may change pricing, plans, and features prospectively. Continued use after a change constitutes acceptance.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWMONKEY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FLOWMONKEY, ITS OWNER, OPERATORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY TRADING OR INVESTMENT LOSSES, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWMONKEY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED.

9. Indemnification

You agree to indemnify, defend, and hold harmless FlowMonkey and its owner, operators, affiliates, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your trading or investment decisions; your violation of these Terms; or your violation of any law or the rights of any third party.

10. Arbitration and Class-Action Waiver

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved exclusively by final and binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. You and FlowMonkey each waive any right to a jury trial.

YOU AND FLOWMONKEY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

11. Governing Law; Termination; Changes

These Terms are governed by the laws of the United States and of the State in which the FlowMonkey operator resides, without regard to conflict-of-laws rules. We may suspend or terminate your access at any time, with or without cause. We may modify these Terms; the version in effect when you accept governs your use, and material changes require renewed acceptance before continued access.

If any provision is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, are the entire agreement between you and FlowMonkey regarding the Service.

12. Acknowledgement

By accepting, you specifically acknowledge that: FlowMonkey provides tools and measurements, not advice; you alone are responsible for your trades and any losses; past and hypothetical performance does not predict future results; and you have had the opportunity to consult your own professional advisors. This acknowledgement, your acceptance, and the recorded timestamp and version constitute your electronic signature to these Terms.
